These Terms of Use ("Terms") are a legal agreement between you ("User") and NadarTech regarding your use of the TrendHook mobile application and related services ("the App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

NadarTech grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App for personal and lawful purposes in accordance with these Terms and applicable laws.

2. Account Registration

• You must create an account to access TrendHook's features. You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate and up-to-date information during registration.
• You are responsible for all activity that occurs under your account.

3. AI Analysis Disclaimer

The App uses artificial intelligence to analyze TikTok trends, generate competitor insights, and produce content calendars. These results are generated automatically and are provided "as is." The App does not guarantee the accuracy of viral score predictions, engagement estimates, or content performance outcomes.

4. Acceptable Use

• Do not upload illegal, harmful, abusive, or infringing content.
• Do not use the App to misrepresent analytics data or competitor information.
• Do not reverse-engineer, modify, scrape, or interfere with the App or its AI systems.
• Do not use the App for unlawful, fraudulent, deceptive, or misleading purposes.

5. User Content & Responsibility

By using the App, you grant NadarTech a limited, temporary license to process the keywords and TikTok usernames you provide solely for the purpose of generating requested analysis results. You are responsible for ensuring that your use of the App complies with TikTok's terms of service and applicable laws.

6. Third-Party Services

The App relies on third-party AI infrastructure (including Google Gemini) and data services to perform trend analysis and content generation. NadarTech is not responsible for the operation, availability, or policies of services it does not directly control.

7. Subscriptions & Payments

• The App offers free features as well as premium subscriptions.
• Pricing, billing terms, and renewal details will be displayed prior to purchase within the App or through the App Store.
• Subscriptions can be managed or canceled via your Apple App Store account settings.
• Payments are non-refundable except where required by law.

8. Ownership

The App, including its software, AI models, algorithms, design, and all related intellectual property, is owned by NadarTech. You may not copy, reproduce, distribute, modify, or create derivative works without prior written permission.

9. Privacy

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your data.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." NADARTECH MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE. THE APP DOES NOT PROVIDE PROFESSIONAL MARKETING, INVESTMENT, OR LEGAL SERVICES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NADARTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING RELIANCE ON AI-GENERATED INSIGHTS, CONTENT PERFORMANCE OUTCOMES, OR LOSS OF DATA.

12. Indemnity

You agree to indemnify and hold harmless NadarTech from any claims, damages, liabilities, or expenses arising from your misuse of the App or violation of these Terms.

13. Termination

NadarTech may suspend or terminate your access to the App if you violate these Terms or applicable laws. Upon termination, you must cease all use of the App.

14. Updates & Changes

These Terms may be updated periodically. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which NadarTech operates, without regard to conflict of law principles.

16. App Store Terms

• These Terms are between you and NadarTech only, not Apple Inc.
• Apple is not responsible for maintenance, support, or warranties related to the App.
• You must comply with all applicable App Store rules.
